          Do people actually read the ToS and notice its not allowed to use/edit or alter images without permission? I see a lot of shops with pictures of popular anime characters and or music groups with actual photos from them. Believe me, asking permission to use photos from Shineee isn't that easy. (I've tried for an order before, it took hours of searching for an official e-mail.) I think if people are going to to that, they should post a link somewhere stating that they have permission and proof of it.

          This is just something I've been noticing around the PG, as well as other topics and forums. Care to discuss?

ToS
Content That You Provide: As a registered member of Gaia Online, you may be allowed to submit content, including artwork, images, and textual content.

Your Rights
1. Copyright protection is really a bundle of rights that exist in "original works of authorship," including the exclusive right to reproduce, duplicate, distribute, sell, publicly perform (if applicable), and create derivative works of your original works 2. Hosting, displaying, and viewing content on a website necessarily involves the exercise of some or all of these rights, and this exercise cannot be done without the author's permission.

We Need Permission to Display Your Content
1. Gaia Online does not claim any ownership rights to your content. However, if you choose to upload and display your works, including artwork, on Gaia Online as a member, then Gaia needs your permission (a "license") to make your content available through Gaia Online.
2. The limited "license" that you grant to Gaia is the legal way to give Gaia the permissions we need to display your artwork within the Gaia Online web site or allow you to share or exchange your artwork with other Gaia members.
3. This license terminates at the moment you choose to remove from the Gaia Online web site your artwork or other original works of authorship.
4. Permission Our Users Need to View Your Content: In addition, if you choose to upload, display for or exchange with other members your works, including artwork, then those Gaia members need your permission (a "license") to display those works within their profiles, on signatures, in messaging, and on other places at the Gaia Online web site.
5. License Limitations: A "license" is not an assignment of rights, but rather just grants permission to exercise limited rights in your works under certain conditions. None of the above mentioned licenses extend outside of our website, and your permission to Gaia and other Gaia members lasts only as long as your work remains on the Gaia Online web site.

Content Submission Rules: Please note that you must own or have the legal right to use and authorize Gaia to use, copy, distribute and display all parts of any works that you upload, download and otherwise copy, distribute and display. Content provided to you by others, or made available through websites, magazines, books and other sources, are protected by copyright and should not be uploaded, downloaded, or otherwise copied, distributed or displayed without the consent of the copyright owner or as otherwise permitted by law.

I also hate it when my customers post an image they'd like me to use even though I have specifically stated in the order form itself "Post a link to an image that you have proof to use. Be sure to include a screenshot of the original artist giving you permission".
Then I message them asking if they have permission to use the image and they're like "I didn't know I needed permission to borrow images"
I simply tell them that the order was declined and to go read the ToS

I'm am so a**l about that as well. >__>;; I have it in my rules at my shop that I won't use images unless permission is given by the artist or they commission the artist themselves.
I've turned down several people already for not doing so. :T

It makes me mad 'cuz I don't want to decline anyones orders but like at least have the decency to follow my rules if you're ordering from me.

          Exactly. I think most shops have it in their rules, even then its stated in the ToS and is a reportable offense if caught. I just wish people would actually acknowledge it..

          Good to know I'm not the only one, I really don't understand what's so hard about reading a few sentences. Although I pixel, I get requests all the time to recreate an image of so and so or this or that, and even that is, and I've turned down many as well. x.x"

          I know how it is. I've had a handful of people who have done that to me, so its understandable. People don't think its that much of a deal, which is kind of insulting.

          Its not very fun having your work be used and then basically edited and claimed as someone else's.

Now I didn't say it was fair to claim as someone else's, but I disagree to an extent. And I don't mean because its "unfair", like most others say; it just doesn't make sense. Where do Gaians get these images from? The internet. As far as I'm concerned, Internet users don't have a magical force telling them to put their works online. They have a choice. And what other reason is there to put images on the internet than for people to use? To show it off? To get feedback from people? I believe that if people are serious about their work to the point that no one else should use it, they shouldn't put it on the internet in the first place, and get feedback from people they know know what they're talking about rather than someone online that you don't even know, like someone who says "Ooh that graphic's nice" when in actuality they don't even know what Photoshop is. Plus, someone who puts their stuff on the internet should be happy about the fact that another person appreciated it so much that they decided to make a graphic, in this case, with it. The only thing I disagree with is making art out of these images, because that's basically selling them, which is stealing, and no one likes stealing. But putting copyrighted images on a thread layout for instance doesn't necessarily mean you're gaining profit out of it.

          I know, I didn't say you did, I was just stating my reasoning, that's all, sorry if you took it the wrong way.

          Again, that is true, but it is copyright laws to do so. I think as long as the artist knows about what your doing then its fine. Just a little note saying their using it, that's all this is for. Understand though there are some people WHO MAKE A LIVING off their art by selling it. So when someone just takes, or uses a piece of their work they're losing profit, which isn't beneficial for them. From what I know, a lot of people use the internet to show off as well.

          When putting an image in a thread layout being made for someone for gold though, it then becomes selling. You have to keep that in mind. It doesn't matter how many times its being sold, just so long as some profit of some sort was made.

The artists who make a living out of selling their work online watermark them and put prices. Check out istockphoto for an example. There are millions of other pictures on the internet that are not there to make money off of, which are the ones I'm talking about. And wouldnt people who want to show off appreciate the further spreading of their work online?
And by thread layout, I meant your own thread. Shop owners on Gaia do not gain profit for the mere existence of their thread layout, no matter what images are used.

I never felt like using an existing image in a graphic/banner/etc was a telling way to say YOU created that image. I mean, it's pretty obvious the image is just there for flair..

And I also do NOT like that rule either. I don't consider myself profiting in real life from using it so why is it against the ToS? I'm not claiming it as my own and I'm not making (real) money from it..?

I hate that rule because I think graphics always look so much prettier with pictures..
But I didn't even know it was not allowed until I opened my shop up. Now it's in my rules, and i'll only accept if they have proof.

But yah, I see a lot of shops with pics of people, and they're not getting in trouble.

It just makes me wanna use pictures even more.
