Alteregoivy, our beloved captain, has been banned for something to do with the translation thing. I have yet to find out more information, but unfortunately, I'm leaving town for a WEEK. Well, a little more.

I was going to make an appeal to Gaia, though, once I had more information. How many of you are with me? *does a geeky heroic pirate sword pose*

Here's Alteregoivy's explanation of things:

"I was PermaBanned. The reason is that it's against the ToS to
trade Gaia gold for actual goods, i.e. translation of copywrited
material. There are a lot of reasons I think that my banning was
unfair, chief among which is the lack of a warning. I wasn't given any
notice that what we were doing was wrong, I was just banned out of the
blue. Secondly, the reason we agreed on Gaia gold in exchange for this
was becuase I'm an amatuer. I couldn't accept real money for my
services, but I wasn't going to do it for free, either. It seemed like
a reasonable solution at the time, and I didn't realize it was against
the rules to do that. Finally, the things that I was translating were
either a)fan-made and thus would never make it to the US or b) had not
made it to be published in the US officially and probably never would
be. Finally, everything that I translated for FoodIsGood (who was also
banned, btw) were actually owned by her in hard copy and scanned in,
meaning that zero copywrite infringement actually occurred, since the
only person it was "distributed" to was the actual person who owned it
in the first place.

Everything we did was totally legal, as far as I know, it's just that
"offsite trading" is against Gaia rules.

A warning would have made me aware and would have put a stop to the
violation, but they didn't give me that opportunity."

I'm going to see what I can do about this, however, I'm leaving for a week. If anyone wants to build up an argument or something, have at it.

Anyone have any thoughts?

EDIT NUMBER TWO:

Gaia said Alteregoivy would have to make a mule account, but I haven't heard back from her after that, so I know nothing. I'm crossing my fingers for good luck on her part so we can have our beloved and more knowledgeable (than I, at least) leader back.

Well, I'm no lawyer but I just re-read the Terms of Service and Rules, and, reading Alteregoivy's side of things, I see no reason for her ban. Alteregoivy was offering a service, offering time to translate a document in exchange for gold. As I understand it, services can be traded for gaia gold, like in Mini Shops (for example, offering time to create dream avatars in exchange for gold), and there was no trade of document for gaia gold. The document was provided for translation, but not traded for.

Also, was this document posted publicly, emailed, sent through PM? That information might be helpfull in understanding the situation. Although it wouldn't be offsite trading if it was the service being paid for. (Unless I'm reading things wrong)

I have not read the ToS. But as with most virtual and/ or electronic service, such as AIM, they give warning. Gaia should be no different, and I fully agree with the previous poster.

Dude, even internet companies send out a warning letter if you're torrenting copyrighted materials (my friend got one from comcast XD said "stop sharing this file or we'll terminate your service and report you to the federal government"). Gaia should have given her the same courtesy.. then again, I've been on gaia since 2004, I've never seen them give warning before permabanning any user.

but I would argue that it was a service.. if you aren't allowed to trade gaia gold for real goods, then art shops and any other services thread needs to shut down =/

The documents were transfered via filesharing website, to which you had to have a specific link. Basically, if you didn't have the link, you couldn't get them. So it's not putting them up for general consumption.

I finally got a reply from Gaia. Basically said that "ignorance of the rules doesn't exempt you from them" and that they sent a warning, I just must not have received it before they banned me. I replied that I check my account every day, so unless they ban within 24 hours, they didn't send me a warning. They give 4 days to accept a ticket solution before closing it; why so quick on the ban? They make it sound like there was nothing I could have done; what's the point of a warning if there's no way to avert further punishment?

I am so angry with Gaia over this; the ONLY reason I'm here now is for the guild. I'm still happy to help you guys and I want to refriend my old friends, but I'm not participating in any other aspect of Gaia anymore.
