To streamline the activity of debating and adopting a new constitution I will create this thread for the posting of new constitutions, and debate/revision for each submission.

I would propose that once adequate discussion has occurred, a motion for the whole guild to vote for two weeks to adopt a constitution be offered. Why not require 2 secondings of said motion.

My submission:

Constitution of the NCS


I. Membership
A. Entry
a. All those who submit an application of membership to the guild and provide a description of their interest in the guild and brief exposition of one’s political beliefs shall be accepted.
b. Rejection will come on the grounds of failure to provide the above or in presenting an explicit exposition which advocates for the destruction of the left tendency of the guild.
c. All rejected candidates will have their application for membership posted in the “General Council” sub-forum. If it is believed that the Council member who rejected the candidate erred, the council can be moved (by a motion seconded three times) to vote amongst themselves to review the application and invite the person into the guild (or uphold the rejection).
B. All members have the privilage to vote in any guild election or referendum and are a member of the Full Congress of Members.
a. This privileges can be revoked due to advocating positions dangerous to the guild – the council will post the names of these individuals within a specially designated thread in the General Council sub-forum. Members may be banned for especially disruptive behavior.
b. Voting in such elections is not mandatory. Voting privileges may not be revoked due to inactivity.
C. Time-based requirements for voting privileges.
a. New members will have a grace period of three weeks before their voting privilages come into effect.
b. Members must have made at least five posts during this time of value.
a. A post of value is one which is not clearly spam.
b. Once the five posts have been made and the time period has passed this member will receive full voting privilages.

II. The General Council
A. Organization
a. The General Council will be made up of five guild members, who are eligible to vote in guild elections and referendums.
b. The General Council will serve a term of three months.
a. Nominations, which will occur in a new, specially designated thread in the main forum, will be held four weeks prior to the end of the council’s term. All members with voting privileges may nominate another member or themselves. The nomination period will last two weeks.
b. Nominees are to provide some exposition of their vision for the guild and current topics.
B. Elections
a. Elections will occur within a specially designated, new, thread within the main forum and will occur in the main forum.
b. Elections will last for two weeks, during which, any member may change their vote. The poll will be closed by an acting council member at the end of the two week voting period.
c. All ties for the first and second chair on the council will be decided by the newly elected council. Should multiple ties occur for the third, fourth, and fifth chairs (particularly which allow for more than five members of the council) will be decided by the previously seated General Council.
d. Members will vote in this format: listing five or fewer names, with candidates listed first receiving five points, second four points, third three points, fourth two points, and fifth one point. The Council will be composed of the top five point recipients.
C. Guild functions
a. The two members who receive the highest, and second highest amount of votes shall be awarded the position of “captain” and “vice-captain” respectively.
b. The other three top recipients of votes will be awarded “moderator” status.
D. Powers of the General Council
a. The General Council will be vested, for the three month term, with full legislative and executive power.
b. The General Council will decide, by majority vote, all issues which currently present themselves to the guild and guide the guild in whatever way they see fit. These votes will occur in specially designated threads within the “General Council” sub-forum.
c. The General Council has full control over every aspect of the guild (though they may not violate or edit the constitution) and may change the name, mission statement, and other similar aspects of the guild at any time.
d. The General Council has full control of all guild assets and may dispose of them as they see fit.
e. The General Council may also convene an extraordinary Full Congress of Members to assist in the making of especially important or controversial issues.
E. Should the council be seen as taking the guild in the wrong direction a recall vote may be initiated at any point. A thread will be created in the main forum, presenting a motion to recall the General Council, this motion of recall must be seconded three times, at which time new elections will occur using the standard four week schedule, during which time all legislative powers are stripped from the General Council. A recall vote may only occur once per three month term.
F. The General Council has the capability to revoke the voting privileges of members, for the reasons mentioned above. The General Council also has the right to ban members for especially deviant or disruptive behavior.
G. All actions and decisions of the General Council will be recorded in a specially designated “sticky” thread in the General Council Forum for ease of review.

III. The Full Congress of Members
A. The Full Congress of Members shall be composed of every member of the guild with voting privileges.
B. The Full Congress of Members is the final authority in the guild and may revise or amend the constitution by referendum, creating a specially designated thread in the main forum. Amendments and revisions will be presented for a one week period, at which time a referendum will occur for two weeks. All issues will be decided by majority vote.
C. The Full Congress will be convened in the final four weeks of the three month term of the General Council.
a. At which time, all policies, legislation, actions, etc, of the General Council will be reviewed by the Congress.
b. Any decision or action of the General Council which is under review may be altered, revoked, or made permanent by the Full Congress of Members. Taken in majority vote.
a. a specially designated thread will be created in the main forum which will record all previous and current Full Congress votes.
b. items of review will be posted in list format, at which time every member of the Congress will voice either: “Full Support, Support with amendments, or Rejection.”
c. A majority vote will occur during the final two weeks of the General Council’s term, the vote on items of review will occur for two weeks.
D. Any banning or revocation of voting privileges may be reversed by the Congress.
E. The Congress may also present their own proposals for vote during the first two weeks of the Congress, which will be voted upon in the final two weeks of the Congress.

IV. Voting Procedure
A. All votes in all parts and arms of the guild will be by open ballot, that is to say, that every vote will be recorded openly in “post” format, and not by utilizing the “poll” function.
B. Votes may be edited until the election, referendum, Congress, or Council session is closed.
C. All votes are decided by simple majority.
D. Votes which are ambiguous will be discounted, therefore members who support a decision should post "support" and those which reject should post "reject" or use a positive response such as "aye, yea, yes, etc" or "nay, no, etc."

V. Committees
A. Committees for any special function or guild activity may be created (such as a guild newspaper, art club, or etc). These Committees have no legislative or executive power, but may carry out various activities relating to their field.
B. Committees are entirely voluntary and members may participate or choose not to at their discretion.
C. Committees may carry out their business in the “General Discussion” sub-forum, or in a specially created sub-forum.
D. Committees may also establish their own rules and government for the committee. However, the Council and Congress retain the right to intervene or to change these rules, regulations, and government at will.

This is Gracchvs/LAR's submission. Any change of format or cut out parts are entirely my fault. I also assume Roy will soon be awarded captain or vice-captain status and will thus gain the ability to edit the below without going through me. If not, I'll delete this post so that he can edit his own document.


Proposed NCS Guild Constitution:

Preamble and Purpose:
The world we live in is conditioned by one central fact: The destruction of the Soviet Union, the first successful proletarian revolution.
As such, working class and socialist ideology has been thrown back all over the world, though in an uneven fashion.
This means the rise of non-Marxist socialist tendencies: From the rise of Green Radicalism and Anarchoid tendencies in the Imperialist Centres to National-Populists in the colonial/neo-colonial world such as the Zapatistas and the 'Bolivarian Revolution' in Latin America.

A pressing need is felt for clarification on the numerous demands and programmes propounded by these socialist [and in some cases not even that!] tendencies.

Therefore, this guild has been created to collect all the socialists and communists on Gaia Online in order to facilitate the exchange of knowledge and help achieve clarification on numerous issues. This is not a party, and as such no ideological demands are made of the membership other than a commitment to a socialism.

This is a place that SOCIALISTS AND COMMUNISTS can come to talk about stuff. The can come here and talk about how to make socialism, how to oppose capitalism, the roots and solutions to all the attending problems.

The guild is NOT here for Liberals to come and deny that capitalism is harmful to the existence of the human race. The guild is NOT here for Libertarians to deny that racism and sexism don't exist. The guild is NOT here so that anti-communists of whatever stripe can question the basic assumptions of our world views.

The guild IS here for socialists and communists to talk about how to understand these things and how to deal with them. People who want to argue with non-leftists can argue in EDP. Once they step into the guild however, SOCIALISM REIGNS.

This guild exists to bring together varying shades of left-wing socialism and provide them with a place where they can learn about socialism and discuss the differences between the various socialist trends without non-socialists questioning the base assumptions or outright denying them.



1. The Rights and Duties of the Membership
i. The members of this guild will not say or act in a way that is contrary to the spirit and purpose of the guild. The exact limits of this are to be set forth in rules in the manner prescribed in section 5.
ii. The members of the guild have the right to not be charged with crimes against the guild or socialist morality without proof being presented.
iii. Membership of the guild is conditional upon adhering to at least 8 points in the 10 point programme.


2. Punishments and Sanctions
i. The only sanctions that can be taken against a member of the guild are as follows. These sanctions are applied to crimes against the guild and socialist morality as put forward in the guild rules.
ii. Probation: The member is allowed to remain a member of the guild however any posts they make after being put on probation will be deleted without exception. Evidence of the violation of the spirit or purpose of the guild or violation of the guild rules must be provided and posted in a motion thread. After one ( 1 ) day deliberation by the guild membership the Central Committee will vote. A majority of two thirds ( 2/3 ) is required to pass the motion to put the member under probation. Repeated posting may be seen as disruptive behaviour and grounds for further sanctions.
iii. Temporary Banning: The member is banned from the guild for a period of no less than one ( 1 ) week and no more than one ( 1 ) month. Evidence of the violation of the spirit or purpose of the guild or violation of the guild rules must be provided and posted in a motion thread. After three ( 3 ) days deliberation by the guild membership the Central Committee will vote. A majority of two thirds ( 2/3 ) is required to pass the motion banning the member.
iv. Permanent banning: The member of the guild is permanently banned. Evidence of the violation of the spirit or purpose of the guild or violation of the guild rules must be provided and posted in a motion thread. After three ( 3 ) days deliberation by the guild membership the Central Committee will vote. A majority of two thirds ( 2/3 ) is required to pass the motion banning the member.
v. Executive Action: If a member of the guild is making posts that repeatedly violate the spirit and purpose of the guild and no other members of the Central Committee is present, a single mod may take Executive Action whereby the offending member has their posts deleted. In extraordinary cases the member may even be banned. Evidence of the violation must be provided in the form of a screencap of the post/s in question. These will be stored in a thread in the Central Committee subforum. PMs will be sent to the member who made the violation and all other members of the Central Committee informing them of this. The PMs sent to the Central Committee members must include a link to the thread containing the screencaps.

3. Elections for the Central Committee and Mods
i. Every member has the right to register for each election. A Thread will be made for each member to register in.
ii. To register, each member must post at least five (5) political posts within the month prior to the election. These posts must be linked in their application for voting registration.
iii. Elections will be conducted in the following manner:
The election is announced one ( 1 ) month prior to the date of the election.
The election will last for one week.
There will be a sticky thread made for the purposes of the election.
Each member has a number of votes equal to the number of Central Committee positions in the election.
Each member will vote for members that they want to participate on the central committee based on their POLITICS and ACTIVITY
Each vote counts for a number of points ranging from 1 through to the number of committee members. Only one vote from each member can count for a given number of points.
The member who receives the most points is elected Chairperson of the guild. The rest of the positions on the Central Committee will be filled by the members who received the next highest amounts of voting points.
In the case of a tie Those already elected vote from the tied candidates for the position.
iv. Elections can be held NO LESS than two ( 2 ) months and no more than 10 ( 10 ) months after the last. The guild should aim to have regular elections held every six ( 6 )
v. At any point where an election would be valid, i.e., no less than two ( 2 ) months after a previous election, the membership of the guild can sign a petition with more than one third ( 1/3 ) of the current active membership for a new election. The new election must be announced within the week.
vi. During period commencing with the posting of the registration thread and closing with the opening of elections no join requests will be accepted or guild invites will be made
vii. The results of all past elections is to be kept in a stikie for this purpost.


4. Central Committee and Mods
i. The central Committee is the executive body of the guild. It will be made up of between three ( 3 ) and eight ( 8 ) members. This will be decided one month prior to the elections based on guild activity and will be included in the election announcement.
ii. Each member of the Central Committee will act as MODERATOR of the NCS Guild and ANY OTHER GUILDS the NCS makes.

5. Rules and Amendments to the Constitution
i. Rules for the guild can only be proposed by members of the Central Committee. To make a new Rule it must be proposed in a Motion thread posted in the main forum of the guild. During the next week the membership of the guild can propose Friendly Amendments to the Motion. The member who proposed the motion is under no obligation to accept these amendments. With the close of that week the motion as it exists is voted upon by the Central Committee. The Motion becomes a Rule of the guild if it passes unanimously. The Central Committee has a period of one ( 1 ) week to discuss the motion and to vote on it, but can make no further changes to it.
ii. Amendments to the Constitution can only be proposed by members of the Central Committee. To make an Amendment to the Constitution it must be proposed in a Motion thread posted in the main forum of the guild. During the next week the membership of the guild can propose Friendly Amendments to the Motion. The member who proposed the motion is under no obligation to accept these amendments. With the close of that week the motion as it exists is voted upon by the membership of the guild. The Motion becomes an Amendment to the Constitution of the guild if it passes by a two thirds ( 2/3 ) majority. The membership of the guild has a period of two ( 2 ) weeks to discuss the motion and to vote on it, but can make no further changes to it.

I don't agree with allowing inactive members voting privileges. It's like adding names of the deceased into polls.

Go ahead. Unless it's not that different to the ones already up, in which case just criticise those points and open them up for discussion.

Also, would like clarification on what this means in Gallenger's constitution:

It is an attempt to suck up by saying 'people can't join if they are open about wanting to purge gracchvs.'

Gracchvs, post the points of your constitution that you particularly like or feel Gallenger's constitution is lacking. point out what in Gallenger's constitution you don't like then I'll see what i can come up with.
