They could always say that he sent them out but douens't remember, but in this day and age, they have jutsu to trace the past thoughts of an individual. So if they got caught and were asked for authentic proof of dispatch, the writing on the scroll might cut it. That is of course, if they don't take Hisaki's Sharingan into consideration.
