IMPORTANT: I've also gotten incredibly sick of having to reply to posts about how this will infringe of copyright laws. I know about the laws! However, it has been stated before by Gaia admins that they can do items simlar to things that already exist (just look at the ninja headbands or shoes; can you honestly say that they come from anywhere but Naruto?) they just won't be exactly the same and will have a different name. If the sand gourd was made to be an item, it would not be the exact same as the one that Gaara has, just as the headband is not exactly like the one in Naruto, though incredibly similar.

The gourd has always been a part of Chinese folklore (Japanese too, but the Chinese had them first). There cannot be infringement of copywrite, because there has always been giant gourds hanging on someone's back. In fact, there was an episode in Monkey King in which he tricked the two demon minions of their stolen magic vases and gave them a giant golden gourd that can 'suck in the sky'.
So yes, Kishimoto-sama thought up of the sand idea, since gourds are usually associated with Fire, Water, occasionally Wind, and poison (In which people are sucked in and melt from the toxic gas inside poisonous vases/gourds), but he did not think up of the original idea. As long as Gaia makes sure that they do not specially associate gourds with Sand, and that they do not include the special markings on Gaara's gourds, Kishimoto would be an idiot to sue.

10/27/07 - As of today the title of this peition has officially changed, thanks to the edits made by elum olegna of different elemental gourds. The idea of elemental gourds was brought to me several times by a couple different people, and I'm so glad that we finally have some examples. Hopefully now this petition will garner even more support than it already has!
*Edit: Here's kind of what the gourd would look like. It is done in Paint and my computer is crappy so it's fuzzy, but the basic idea is there.

Another idea that has come up is to have different poses, such as one with the sand coming out of the gourd. If anyone could make an edit of this, that'd be awesome whee
The next idea that had resurgaced a couple of times is that, instead of just being a sand gourd, it could be more of an elemental gourd, with the ability to manipulate the different elements (sand could be earth). This would take the item away from being too Naruto-ish, and also allow more people to enjoy the item. If anyone could make edits of this, that'd be awesome ^^
